1. Appointment Scheduling:
– All appointments must be scheduled in advance through our designated booking request form or by contacting our staff.
– All appointments through our online booking request form are subject to availability and must be confirmed in writing by sms text message or email from Namwarn Thai Massage staff.
– Same-day appointments may be available but are subject to availability.
– We require a minimum notice period of 24 hours for cancellations or rescheduling. Failure to provide adequate notice may result in a cancellation fee.
2. Service Fees and Payments:
– Fees for services are clearly outlined and agreed upon before the commencement of any treatment.
– Payment is due at the time of service unless prior arrangements have been made.
– We accept payment by: cash, credit and debit cards.
3. Health Considerations:
– Clients must disclose any relevant medical conditions, injuries, or allergies before receiving any treatment.
– Our therapists reserve the right to refuse or adapt treatment based on health considerations for the safety of the client.
4. Conduct and Respect:
– Clients are expected to behave respectfully towards our therapists and other clients.
– Any inappropriate behavior, including but not limited to harassment or intoxication, will result in immediate termination of the session, and the client may be asked to leave.
5. Confidentiality:
– All client information and conversations during appointments are confidential unless required by law.
– We adhere to strict privacy and confidentiality practices in accordance with applicable laws.
6. Liability:
– While we take every precaution to ensure your safety during treatments, we are not liable for any injuries or damages that occur as a result of undisclosed medical conditions or failure to follow therapist instructions.
– Clients agree to release Namwarn Thai Massage and its therapists from any liability for injuries or damages incurred during or after treatments.
– Whilst all possible steps are made to ensure the safety and privacy of your information we are not responsible for any security breaches of third parties that we may use to supply online booking, email, online purchases as we have no control over their security measures.
– You indemnify us and its officers, employees, subcontractors, contractors, affiliates, advisors and agents (those indemnified) from and against any claim, action, demand, damage, loss, liability, cost, charge, expense, outgoing, fine or payment which any of those indemnified pays, suffers, incurs or is liable for arising out of or in connection with:
i) any breach of these Terms of Use by you or someone accessing your profile using your identity details, whether authorised or not; and
ii) any breach of law or infringement of a third party’s rights; and
iii) any act or omission of fraud, dishonesty, reckless or wilful misconduct or misrepresentation, to the extent caused or contributed to by any act or omission by you.
– Notwithstanding any other provision of this Agreement, the liability of a Party arising under and/or in connection with this Agreement will exclude any liability for indirect or consequential loss.
– To the maximum extent permitted by Law, our aggregate liability in respect of any causes of action arising under or in connection with these Terms and Conditions, whether in contract, tort (including negligence), statute, equity or otherwise, is limited to an amount equal to the cumulative total fees for Services paid or payable by you to us, for the first 6 months of Services engaged within the previous 12 months.
7. Feedback and Concerns:
– We welcome client feedback to continuously improve our services.
– Any concerns or complaints should be addressed directly to our management for prompt resolution.
8. Changes to Terms and Conditions:
– Namwarn Thai Massage reserves the right to update these terms and conditions from time to time.
– Clients will be notified of any changes, and continued use of our services after notification constitutes acceptance of the updated terms.
9. Governing Law:
– These terms and conditions are governed by the laws of Queensland, Australia
– Any disputes arising from these terms will be settled in the courts of Queensland, Australia
